VA Police Officers are appointed by the Secretary of the Department of Veterans Affairs. VA Police are federal law enforcement officers. They have the same law enforcement powers and authority as State and Municipal Police Officers. VA Police are empowered under Title 38 of the United States Code (Section 902) to perform all law enforcement duties on VA owned and controlled property through the enforcement of federal, state and local laws, as well as VA rules and regulations.

VA Healthcare Network Upstate New York facilities are under the "exclusive" jurisdiction of the United States Government. Local police do not patrol grounds or buildings and do not exercise any law enforcement authority while on federal grounds. However, full cooperation is given to local law enforcement agencies when necessary to apprehend criminal suspects or serve criminal and civil process.

VA Police enforce posted rules and regulations to include speed limits and parking regulations. Enforcement action is through usage of Courtesy Violation Notice, U.S. District Court Violation Notice or physical arrest as appropriate.
